Call and text regulator PhonepayPlus has fined ringtone company Mexel £75,000 after it was deemed to have breached a number of rules regarding downloadable content.
The fine was not issued to Mexel host company mBlox, as reported in Mobile News issue 434.
PhonePay Plus issued two separate fines after Mexel, formerly Text Media Limited, broke regulatory rules by providing misleading and unclear information on price and failing to abide by the universal ‘Stop’ text message to end any agreement and cease any chargeable texts being received.
The first charge, which resulted in a fine of £25,000, was for a text service to receive ringtones called Ringtones2go, and the second being a fine of £50,000 for a similar service called gummybearringtones.
PhonepayPlus has also demanded a full refund to all customers affected.
